Terms of Service

1. What Mags is

Mags is an SMS-based assistant operated by Magpies & Co (“we,” “us”). You text a phone number; Mags captures what you tell her, reminds you at the times you asked, follows up on open tasks, and remembers where you said things are. Your phone number is your account.

2. What Mags is not

Mags is not a medical device, treatment, or therapy, and she does not provide medical advice, including medication or dosing guidance. She’s an organizational tool. If you’re seeking diagnosis or treatment for ADHD or anything else, please work with a licensed clinician. If you text something indicating you’re in crisis, Mags will share crisis resources (like the 988 Suicide & Crisis Lifeline in the US) and step back. She is not an emergency service, and if you’re in immediate danger, call 911.

3. Text messaging terms (the carrier-required part, which is also just true)

• By texting Mags first, you consent to receive recurring automated text messages from us at that number. Message frequency varies with how you use the service: that’s the point of the product.
• Message and data rates may apply, per your mobile plan.
• Text STOP at any time to halt all messages. Text HELP for help or contact textmags.com/help. Text START to resume after a STOP.
• Consent to receive texts is not a condition of any purchase.
• Carriers are not liable for delayed or undelivered messages. We work hard on delivery (it’s our entire job), but SMS is not a guaranteed-delivery medium. Don’t rely on Mags as your sole safeguard for anything where a missed message would cause serious harm.
• Quiet hours: by default Mags won’t text you between 9:30pm and 8am your local time, unless you’ve explicitly asked her to (e.g., an early leave-by alert).

4. Trials, billing, and leaving

• New accounts start with a 7-day free trial. A card is required to start — you will not be charged until the trial ends, and cancelling by text before then means you are never charged at all.
• When the trial ends, the membership starts automatically at the price stated when you signed up (currently $29/month; pilot participants may have a different agreed rate), billed monthly through Stripe. We remind you by text before the first charge.
• Cancel any time by texting “cancel my subscription” (or from your account page, once that exists). Cancellation takes effect at the end of the current billing period; you keep full service until then. No cancellation fees, no retention hoops, no guilt.
• If a charge fails, we’ll tell you and retry; we don’t cut service off the same day.
• Refunds: if something went wrong on our side, email us. We’re reasonable.

5. Your side of the deal

• You’re 18 or older and the number you use is yours.
• Don’t use Mags for anything unlawful, to harass anyone, or to send content you have no right to send.
• Don’t attempt to break, probe, or overload the service (we’ll suspend accounts that do).
• The service depends on third parties (carriers, Twilio, Stripe, Google for optional calendar). We’re responsible for our service, not for their outages.

6. Your data

Your privacy terms live in our Privacy Policy, including the four promises: no selling data, no training AI on your messages, full export, and real deletion. That policy is part of these terms.

7. Our liability, in plain words

We provide Mags “as is.” We promise real effort and real care, but not perfection: reminders can occasionally be delayed or fail (see §3), and we’re not liable for consequences of missed or delayed messages beyond what you’ve paid us in the past 12 months. Nothing in these terms limits liability that can’t legally be limited.

8. Changes and ending service

We may update these terms; material changes get posted here with a new date, and continuing to use Mags after that means you accept them. We may discontinue the service with reasonable notice, in which case you’ll get your export offer without asking. We may suspend accounts that violate §5.

9. The boring necessities

These terms are governed by the laws of the State of Georgia, USA. If any clause is found unenforceable, the rest stand. These terms plus the Privacy Policy are the whole agreement between us.
